Privacy Policy

THE VISUA (Pty) Ltd | Cape Town | Updated 12 October 2026

This policy explains how THE VISUA (Pty) Ltd, trading as The Visua ("we", "us" or "our"), handles personal information when you visit our website, enquire about or book our Cape Town services, or apply to join our network of independent professionals.

1 Responsible party and contact
THE VISUA (Pty) Ltd is responsible for the personal information it collects and uses for the purposes described here. Contact us using the details below for privacy questions or requests.

2 Information we collect
For enquiries and appointments, we collect your name, phone or WhatsApp number, email address, service location and access instructions, requested service, preferred date and time, relevant preferences, and communications with us. We also keep the booking confirmation, payment status, transaction references, invoices, refunds and any service feedback or complaint.
Where necessary for a particular procedure, we may ask about relevant allergies, sensitivities, pregnancy, injuries or other conditions affecting safe service delivery. Please provide only information relevant to the service, rather than a full medical history or unnecessary information in free-text messages.
For professionals applying to join our network, we may collect identity and contact information, relevant training and qualifications, experience, portfolio, references and previous work contacts, practical assessment results, availability, and payment details. Any background screening or criminal-record information is collected through a lawful process, with appropriate notice and consent or other required authorisation. Professional information is used for selection, safety, contracting and administration.
Our website and hosting services may process technical information such as IP address, device and browser details, page requests, referring links, security logs and website usage statistics. Cookie-related processing is described in our Cookie Policy.

3 How and why we use information
We use information to respond to enquiries, prepare quotes, arrange and deliver appointments, assign suitable professionals, communicate booking updates, take payments, issue invoices, process refunds, handle complaints and maintain business records. We also use necessary information to assess service suitability, protect clients and professionals, secure our systems and meet legal obligations.
Our grounds for processing include taking steps at your request, performing our agreement, complying with the law, pursuing legitimate business interests with due regard for your rights, and consent where required. Providing booking details is generally necessary to arrange the service; without essential information we may be unable to proceed.

4 Health information and consent
We treat health-related information as sensitive. Before collecting and sharing such information for service suitability, we explain the purpose and obtain specific informed consent where required. Access is limited to those who need the information for the agreed service or a lawful purpose. A professional may recommend postponement, a patch test or medical advice if a procedure appears unsuitable. Withdrawing consent may prevent us from safely arranging that procedure, but does not undo lawful processing already carried out.

5 Sharing information
We do not sell personal information. We share only relevant information with the professional assigned to your appointment, for example your contact details, address, service instructions and necessary suitability information. We may also share information with website and communications providers, payment and banking services, accountants or legal advisers, and lawful authorities where necessary. A hotel, host or other referrer receives booking information only where authorised or needed for arrangements you request.
We use Tilda for website hosting, WhatsApp/Meta and Google Gmail for communications, Paystack and banking services for payments, and a customer relationship management (CRM) system for enquiries, appointments and client and professional records. Documents may be received through WhatsApp or Gmail and recorded in our CRM where necessary. Access is limited to authorised people who need the information for the stated purpose. Service providers handling information on our behalf must follow appropriate confidentiality and security obligations.
Card payments are processed through Paystack's payment page. We do not collect or store your full card number or card security code. We receive payment confirmations, relevant contact and transaction information, and records needed for invoicing, reconciliation and refunds. EFT payments are made to the bank account provided by THE VISUA. Please do not send full card details or security codes through WhatsApp or email. Paystack's privacy terms are available at https://paystack.com/za/terms.

6 International processing
Website, email, messaging and other providers may process information outside South Africa. We assess the applicable safeguards and use a permitted transfer ground under South African law, such as adequate protection under a binding agreement, consent where appropriate, or necessity for the requested contract.

7 Marketing photographs and reviews
Booking messages and reminders are service communications. Promotional messages are sent only with consent or another lawful customer basis, with an easy way to opt out. You can ask us to stop marketing at any time; this does not stop necessary messages about an active appointment.
Photos, videos and identifiable reviews are used publicly only with your separate permission for the stated purpose. Agreeing to a booking is not permission to publish your image, address or private messages. You may contact us to withdraw permission for future use, subject to applicable law.

8 Storage retention and security
We keep information for as long as reasonably needed for the purpose for which it was collected, the service relationship, complaints or disputes, and applicable tax, accounting or other legal requirements. Health and screening information is kept only for a justified purpose and period. When retention is no longer justified, records are securely deleted or de-identified, subject to lawful holds and routine backup processes.
We use reasonable technical and organisational safeguards, including access restrictions and appropriate confidentiality arrangements. No system provides absolute security. If a security incident requires notification, we notify the Information Regulator and affected people as required by law.

9 Your privacy rights
Subject to applicable law, you may request confirmation that we hold information about you, access to it, correction of inaccurate information, or deletion where we are no longer entitled to retain it. You may object to processing on applicable grounds, object to direct marketing, and withdraw consent where processing relies on consent. We may verify your identity and explain any lawful restriction on your request.
Contact thevisuainc@gmail.com to make a request. You may also lodge a complaint with the Information Regulator South Africa: https://inforegulator.org.za. Access requests may be subject to the applicable PAIA procedure.

10 Adults only and policy updates
Our services are for people aged 18 and over. We do not intentionally collect information from children for service bookings. If such information is sent to us, contact us so that we can address it appropriately. We update this policy when our practices change and show the revision date above. A new purpose requiring consent will be presented separately.
